Why Florida Has Strict Pool Barrier Laws

Drowning is the leading cause of accidental death for children under five in Florida. The Residential Swimming Pool Safety Act was created to reduce these tragedies by requiring every new or modified residential pool to have approved safety features like fences, alarms, or covers that prevent unsupervised access. Barrier Height
The barrier top must be at least 48″ above grade, measured on the outside (away from the pool). Required

Gap under the barrier ≤ 2″ (or ≤ 4″ if the barrier sits on top of an above-ground pool wall).

Openings & Gaps
No opening may allow a 4″ sphere to pass. One end of any removable barrier must require tools to detach.

Climb-Resistant Design
No protrusions, indentations, or footholds that a child could climb. Smooth, clean lines are best.

Vertical/Horizontal Spacing
If horizontals are < 45″ apart, they must face the pool; vertical spacing ≤ 1¾″.

Chain-Link / Diagonal
Chain-link: ≤ 2¼″ (or ≤ 1¾″ with slats). Diagonal lattice: ≤ 1¾″.

Self-Closing Gates
Gates must self-close, self-latch, open outward, and have the latch at ≥ 54″. No opening > ½″ within 18″ of the release.

Doors / Windows to Pool
Require an exit alarm (UL 2017), a self-closing & self-latching device ≥ 54″, or an approved ASTM F2208 pool alarm.

Above-Ground Pools
Ladders/steps must be locked, secured, or removable when not in use—or enclosed by a compliant barrier.

A compliant screen enclosure may serve as part or all of the required barrier.

Barrier Placement
Barrier must surround the pool’s perimeter and be separate from yard fencing unless that fence sits on the perimeter and meets all rules.

Removable child barriers must be at least 20″ from the water’s edge to prevent immediate falls after breach.

A dwelling wall may count if no doors/windows give direct access—or those openings meet the alarm/locking standards above.

Mesh: ASTM D5034 (100 lb tensile) & D3787 (150 lb burst), UV-resistant, ≤ 1″ above deck. Posts resist 52 lb, extend 3″ below deck, ≤ 36″ spacing; latches ≥ 45″.
